EACC Recovers KSh51 Million KCAA Land in Nyali, Mombasa, After 17-Year Battle

The Ethics and Anti-Corruption Commission has recovered a 0.514-acre parcel of public land in Nyali, Mombasa, valued at KSh51 million, after its registered owner agreed to surrender the property to the government.
The Ethics and Anti-Corruption Commission (EACC) has recovered a 0.514-acre parcel of land valued at Ksh.51 million belonging to the Kenya Civil Aviation Authority (KCAA) in Nyali, Mombasa County.
The recovery follows a settlement reached on September 21, 2026, in which the registered owner, Omar Tahir, agreed to surrender the property to the government, ending a legal dispute that had dragged on for 17 years.
The land, registered as MN/I/2411, was at the centre of a case filed by the commission at the Mombasa Environment and Land Court in 2009 against Zakayo Kipkemboi Cheruiyot, Mr Tahir and former Commissioner of Lands Sammy Mwaita.
According to the EACC, investigations established that the property was irregularly allocated in 2000 by Mwaita to Cheruiyot, a former Kuresoi Constituency MP, who later transferred it to Tahir. The commission pursued the recovery through civil proceedings before the parties reached an agreement under the Alternative Dispute Resolution (ADR) process.
The EACC said the property has now reverted to public ownership for its intended purpose, and urged individuals holding public property acquired illegally or irregularly to surrender it voluntarily, saying the approach could help restore public assets while avoiding prolonged court battles and their associated legal costs.
