Kilimani Court Rejects Bid to Halt Turbo Road Apartment Project

Written on

Kilimani residents tried once more to stop a rising high-rise on Turbo Road and failed. The court says the case is already settled, clearing the way for construction to continue.

A Nairobi court has dismissed an application by Kilimani residents seeking to halt a high-rise residential development along Turbo Road in the Kilimani area. The court ruled that the dispute had already been determined in earlier proceedings, and could not be reopened without valid new evidence.

The case stems from long-standing opposition by a residents’ association arguing that the project violates planning rules, exceeds zoning limits, and negatively affects neighbouring homes. Authorities and developers maintained that the building had received the necessary approvals and complied with planning regulations.

The ruling reinforces a wider pattern in Nairobi where courts are increasingly reluctant to stop approved developments in fast-growing residential zones like Kilimani, even amid concerns about infrastructure pressure and changing neighbourhood character
